Any facts, legal if possible about my next door neighbour smoking, the smell gets into my flat which I find very annoying

it is not illegal to smoke in your home ,in a block of flats it is illegal to smoke in communal areas such as corridors and stairways so back off please

If the actions of your neighbor is causing your flat to fill with obnoxious odors then I'm pretty sure that you could do something about it - second-hand smoke is also a serious danger to your health. Talk with your landlord about your concerns - you're entitled to have a healthy living space. :-)

sorry but its legal, in any building classed as a home, which includes care homes, prisons and flats it is still legal to smoke

I also have this problem and im thinking now the no smoking in public areas law has started that they should ban smoking in the hallways in flats. Agree?

theres nothing you can do.
Its like your neighbour cooking smelly food and you complaining.
For gods sake get a life, you are lucky this is all you have to worry about.
People like you make me so angry.

now this is really getting on my nerves! i smoke in my own house am i allowed to pass wind? you must be having a laugh bazza surely we have some human rights!

That is against the law what you flat mate is doing as a flat is classed as a public building, he should go out side to spark up

i'm guessing you're in the uk? laws are different everywhere but i don't think you could take this one to court.

I assume your in the UK, building reg's would seem to make this impossible. Are you sure or is it you just have a downer on smokers?????????????????????
