We filed as married separate (state of colorado).

You can only file as head of household if:

a) You were legally not married on Dec 31 and had a qualifying child living in the home during the year and paid more then 50% of the cost of maintaining a home for said child. OR

b) Did not live with your spouse FOR EVEN ONE NIGHT for the last six months of the year and had a qualifying child living in the home and paid more then 50% of the cost of maintaining a home for said child.

If you qualify for head of household filing you have three years from the due date of the return to file an amended return for a refund. If you don't qualify and your spouse and you can tolerate each other, you may still be able to benefit by amending to a joint return.

If you didn't live together at any time, even one night, for the last half of the year, and you provided more than half of the cost of keeping up a home for the year, and your home was the main home for your child for more than half the year, you could probably file as head of household. If you originally filed as married filing separately, you could amend your return to head of household status. Otherwise, no.

You can only file as head of household while married if you did not live together after June 30. Otherwise, you have to file Married Filing Separately. If you and your soon to be ex are on speaking terms, you could have filed a joint return.

If you filed your return as married filing separately, you can amend your return to head of household if you qualify as described in other answers.

You can also amend your return to married filing jointly if your spouse agrees.

Check with a tax professional, especially if you recieved the earned income credit, that could be a bit messy. But you can always amend, you just may have to pay a fine or fee or something.

If you are married you do not qualify as head of household for federal income tax purposes.
