Fruit - in its strict botanical sense, the fleshy or dry ripened ovary of a plant, enclosing the seed or seeds. Thus, apricots, bananas, and grapes, as well as bean pods, corn grains, tomatoes, cucumbers, and (in their shells) acorns and almonds, are all technically fruits.

Botanically, a fruit. Legally (for purposes of commerce) in the U.S. at least, a vegetable.

you know what you caught me with this question, My sister is in botany and asked me the same question many years ago, and to this day when we have dinner together and have tmato in our salad, we say together, why is there fruit in our salad,? So theres your answer, tmato actually is a fruit, not a vegtible, people thinks its a veg, but actually its a fruit, just like peanuts are not nuts they are a vegtible, so look it up, peanuts grow on vines from the ground, Well thats all i know

in my book a vegitable but others consider it a fruit because of its seeds, juice, and grown out of the ground off a stem.

its a fruit grown on a tree not in the ground and its picked soo yea a fruit i used to be pickled about that lol
