Can someone advise how the insurance company will handle this? Incident occured in California. Brother 24, does not have a DL, this will be the 2nd time he is caught driving without one. To make matters worse he totalled parents car & may have been driving under the influence of alcohol. This happend last night and we are on our way to visit him at the hospital. We understand the DUI laws have become tougher and we understand he may have to serve some jail time plus fines if he's convicted of the DUI. My question is, will the insurance pay for the damages to the vehicle and or hospital bills. he doesnt have health insurance and was not listed as a driver in our parents policy (no DL). To my knowledge my parents did not let him borrow the car. My parents have full coverage and we are getting ready to call them to report the claim BUT can someone advice how they will handle this? we obviously want the insurance company to pay for the damages. any advice will be appreciated.

If he lives with the parents they may deny the claim for these reasons...
1. He has no license so he was operating illegally.
2. He didn't have permission to use the car, which is also illegal. If your parents say they gave him permission they'll deny the claim because they gave a car to someone they knew had no valid license.
3. If he has a license and it's suspended, he should have been listed on the policy as a driver. Few if any companies will cover a non-listed household member.

Your brother (and very possibly your parents) are in serious financial and legal trouble. I hope he didn't hit anyone else as that will make the situation much worse. Find a good attorney soon and report the accident ASAP. Your brother may very well face jail time for unauthorized use of a motor vehicle, driving without a license, and possibly DUI.

I am unsure exactly of the laws in Cali but in the state of Ohio if your brother was not listed on your parents insurance policy the insurance will not cover any of the medical bills that your brother has sustained. If your parents had full coverage on their vehicle they may perhaps cover the damage to their car. Your brother will most likely serve some jail time! I hope that he is well and that all works out well for you and your family especially your brother! Good luck!!

The charge could be greater. Brother basically stole the car. Doesn't matter if related....he took the car. It probably has to be reported as a theft. The insurance are wiping their hands of DUI's so coverage there may be non existant. Be prepared for the worst and that may be the good news.

Along with everything else, your brother will have an additional charge of unauthorized use of a vehicle if not full theft. Yes, insurance will cover it, but your parents policy will go sky high after this.

Damage to the car will be covered because it is technically a stolen vehicle. Insurance will not cover his medical bills however. Medical liability is for injuries that the driver causes to others, not himself. I'm sorry for what your family is going through but I'm sure glad he's off the streets when my family comes through your town.

The first thing to do is contact a lawyer before you talk to the insurance company.

If your brother was charged with DUI on the police report, he will need the lawyer more so than your parents.

Just talk to the lawyer before the insurance. Good luck on this one.
