how do they do that? my boyfriend is in jail now and he was ordered by the courts on friday to serve two months in county jail followed by 6 months in drug rehab. mind you he is not a drug addict, he just smokes weed, but he used that tactic to get his actual jail time reduced. he tried to call me yesterday collect of course, and i wasnt home but on the answering machine it says "you have a collect call from" and he said "i maybe fucked for another year". I know he had to have a physical, is it possible that they gave him a drug test? how long does pot stay in your system? Hes a pretty big guy, bout 260 lbs. i believe it would also be considered a violation of his original probation.

Yes you can get additional time on your original sentence while you are incarcerated. If you are convicted of a new crime, or convited of a disciplinary that may take sentence credits. Most states do not give additional time for failing a urine screen, they may however take sentence credits (such as two for ones, or work release credits) Unless he was actually caught with the drugs, than that is a new charge, Introduction of contraband into a penal facility, and may carry stiff punishment if drugs. Marijuana can stay in your system for around 30 days depending on the amount of body fat in your system. THC is stored in fat cells until your kidney is able to process it and pass it as waste. So if he is a big fella, he is dicked! Have a good one, tell him to sober up!

yes, they could add additional time. How could he get drugs while in jail or in rehab? I'm confused?

I hope you have an attorney - at least notify them and let them work on it. We had a case locally go back for "re-sentencing" because the judge said the original jury wasn't given proper instructions. This was such a waste - because it was a life sentence, plus 15 anyway. They changed it - they added 31 days to the sentence. WASTE of money. If you contact your attorney, maybe you can convince them not to spend taxpayer money on something foolish.

You sure can. In many different ways. Up to 5 years for attempted escape. any other laws broken. assault, murder, drug possession. they all carry the same penalties as they do on the outside. Dirty drug test implies possession and use. Penalties vary. In FED they will move you out of a camp into hard core population. More time, worse conditions. Worth it. Depends how good your drugs are and the real answer is NO.

yes, if you commit another crime while in jail they will add more time to what you already have, and failing a drug test will definatley get you more time. weed stays in your system for a long time at least 60 days.

Yes, you can get additional time added on to your sentence if you commit other crimes. If you fail a drug test then you won't be going to see parole officers as soon as you would have. You can't take drugs if you want to be released early - you HAVE to be a model prisoner.

Yes, he can get time tacked on to his original sentance for all sorts of things. Drug taking, fighting, anything really. He obviously isn't learning his lesson and behaving himself whilst he's in there, is he? Oh well, never mind. Just tell him not to drop the soap.
