A pre-trial diversion is similar to probation, the DA will set a time, usually 6 months to a year for first offenders. If your daughter stays out of trouble during this time all charges will be dropped and she will not have a conviction on her record. However if she does get in trouble during her diversion she is automatically considered guilty, without a trial. As many of the others have said, judges and DAs are human and it is very important that they see your daughter trying to straighten up....The fact that she told them about the pot is a good thing. If she had been taken into custody and they found it during booking into jail it would have been a felony. As is it's a simple misdemeanor... Go for the pretrial diversion, help your kid see the straight and narrow path and everything should turn out alright.... Make DAMN sure she is off the pot at least a month before court. Since she has a drug charge there is a BIG chance that she will have to submit to a urinalysis for the DA and she needs to be CLEAN, CLEAN, CLEAN...

Depends on his criminal history and plea bargain agreements with the prosecutor. In some states it might be a 2 to 5 year prison sentence with eligility for probation in 6 months. He will have a hard time finding work on a theft charge so he is burying himself.

He's going to jail for a long time. intent and prior history have a lot to do with setencing too. If he knew the check was fake and he has a prior history, the harsher the sentence and vice versa. He sounds like he needs to go to jail, since he such a smart***

We've all seen way too clearly how messed up the California jails are! I would think the sentence would probably be 12 months, and chances are, he might serve 30 days.

6 Months to 1 year. And you wont get a penny back. If you really need to look up the arrest records, see the real charges, go to the police dept. get a copy and see a lawyer. only he/she can tell you exact amounts. Sad but true. G/L
