If your neighbors are destroying your property with their sewage and stormwater and you can't stop them without going to court, can your insurance company hold that against you?
Even if you have done everythng possible short of suing? If your insurance is cancelled, will another company insure you under the circumstances?

You are required to take steps to minimize the damage. Your first stepo should be to get in touch with the local government. There are laws regarding discharging sewage and waste water onto anothers property.

Next I would get an attorney and go after them.

Yes, your insurance company could hold it against you if you know about the problem and haven't done anything to stop it.

If someone caused covered damage to your property, and the insurance company paid a claim, they would go after the at fault party to get the money back. Since this hasn't happened, I am guessing that you haven't presented a claim yet. Depending on your policy, you might not have any coverage. Also, this might not be a covered peril if this is something that causes damage over an extended period of time, and you know that this is causing damage and not taking action to prevent it.

You need to take action to prevent this damage to your property. Don't worry about involving insurance.

Well, they don't hold it against you, but if you won't take that final step, they're certainly not obligated to keep COVERING you.

Why won't you make them stop? You CAN'T, you know, without going to court. NOt going to court is the same as not making them stop. What, you're sitting on your property line saying," no. don't. stop." like that's going to do anything?

Pretend you have no insurance, and these people are damaging your property. What would you do? That's what you should do, anyway.

No company in the world is going to insure you with ongoing, unrepaired damage. You'll be uninsurable.

I'd call the police instead of the insurance company.

And you need to call the police and have them talk to them. I don't know how the Ins. Co. would look at it , but they would probably expect you to legally get them to stop. They aren't going to continue to pay for the same problem , over and over,
