I would ask if there were any legal implications in you setting up a temporary CCTV camera. I think you could even rent one. I guarantee that will stop the idiot. If/when you find the offender, feel free to post the turds in his mail box or leave it on his doorstep.
People who don't clear up after their dogs make my blood boil. This man/woman needs a hard, cold taste of reality. No one should have to pick up someone elses dog...disgusting!

I think that you can try to solve this problem psychologically and cheap. First of all there is Dog repellent that you can spread around your lawn to keep him away. Dogs usually sniff the area and by having repellent on it, it will whine and run off. Since the dog repellent requires upkeep and might not be suitable for some lawns,you could also have a community meeting and setup a $100 community reward for any information or evidence leading to the citation of any person who does not pick up after their pet. Make sure that the person you think that is doing this receives the newsletter about this new community action. Just in case send a reminder once a week during one month. If this doesn't work then you can make a civil lawsuit, but for this you need evidence. It is important to check if in your state you can submit videotape as evidence (considering that in some states and U.S. territories videotape or audio is not submissive as evidence in court) .

As a dog owner, I think this guy is a disrespectful idiot! If my dog does his business in my neighbors yard with or without a law I pick up the poop out of respect. People like the goof ball you describe just makes those that are not fond of dogs to want legislation to outlaw pets everywhere. I don't want that, so I hate people that are irresponsible like this.
Can you set up a security camera? That could capture the evidence you need.

IF u can install video camera to scan your yard, I would DEF consider that. dont worry about offending "that" neigbor since they DEF don't give a s hit about offending the rest of their neighbors. This also makes my blood boil. I not only pick up my dogs poo on a walk, but in my own yard as well.
I like the idea of the reward for catching the offender. the HOA shouldn't worry about stepping on their toes, coz it's better than stepping in ****! If they believe there is some consequence, perhaps they'll make an effort. childish, but if somebody continually abused my yard, I would not be above putting it back in their yard, mailbox, frontdoor, etc. what I would never doo but would like to is collect alot of poo for a couple of weeks and litter their yard! :) call animal control to come to your homeowners assoc meeting and address this issue and send out minutes of the meeting with a warning! a neighborhood watch, and follow through on calling animal control if further violations occur!!!

Short of someone seeing this happen, I don't see that there is much, if anything you can do.
If you accuse someone without a witness and they deny it, your out of luck.
At the same time, the home owner's association could do some things to publicize the fact that they are not happy and that if the offender is caught the consequences will be . . .
If you get REAL lucky, maybe the notice will be enough to cause the person to change their ways because they know that others are going to be more vigilant about looking for the perpetrator.

The idea about the nieghborhood watch is really good. But maybe on that particular nieghbor's door, along with a note about the watch and doggie duties, you could leave them a gift. A pooper scooper. Maybe that would send the message that you all know it is him not cleaning up after his dog. Plus it would be done in a nice way.

I think I'd use the obvious approach. Set up a camera in plain sight (perhaps out your front window with a light shining on it). Let the offender know you are filming them. Perhaps that might deter them from letting their dog use your yard as a toilet.
Another thought: could it be a stray dog in the neighborhood?

If it is that much of a problem, set your alarm or whatever and actually see the dog in the act. Later go out and deposit the left overs on his side walk so it will be there in the morning. Im sure a time or two of that and he will get the message.

The HOA can issue a notice to all the homeowners reminding them about the dog ordinance - and what the consequences are for violating it.
Then, volunteers can establish a "neighborhood watch" program - for catching prowlers of course - but other people can be "watched" as well.
Then it's just a matter of time before the offender is caught with his dog's pants down.
Once you do catch the doo-doo bandit, what are you going to doo with him?

Without an eye witness how do you know who is the culprit?
You need to catch your neighbor in the act of not cleaning up after his dog and then confront him immediately.
