I believe you'd just have to say, if there's ANY doubt, then don't go there. If she's not 110 percent in control of her faculties to give you consent, then take a cold shower and go home.

Rape is having sex with someone who either does not want it, or cannot express that, or who cannot comprehend the situation. Having sex with a tipsy girl is not rape, if she can comprehend the situation. Having sex with a girl who is incapacitated (blind drunk) could be argued to be, especially if you are in control of your capacities. I've had my share of mornings waking up next to someone and not knowing where I was, and them not knowing me very well either, but I knew I made the choice to drink that much. Given that, I would not call it rape. However, if I had been stone sober, and gone to a party to pick up a woman who is off-end wasted, then at the very least I am a shady mo-fo. It's a difficult line to draw, being that "Being incapacitated" is subjective. In the case you outline though, no that is not rape.

To have sex with someone who may have the slightest bit of a chance of not being totally consensual, I would call it rape. If the there is a chance that she's not in her right mind at all, then yes, I would call it rape.

If she liked it and NEVER said no, I would guess it was consentual. If you were drunk too, even more consentual. Never trust drunk women, the make a mistake and try to blame it on the man, usually ruining their life,

If she said no, then it is rape. If she consented, then it is not rape She may regret it and hate you afterwards, but if she wasn't falling down drunk, then she has responsibility for the situation too.
