I have a warranty claim on my new car and ford will not honour it,so I'm taking them to court, so i just wondered if anyone on here has taken on a giant and won?

This is for "Bikertrash"The warranty claim is for the alloy wheels on my Fiesta ghia,the problem is that the varnish has degraded on them and black dots and streaks appeared under the varnish,the ghia wheels are nice looking and this marking completely ruins the look.the wheels were photographed by the Ford repair shop manager and i was told there was no problem as i had complied with all aspects of the ford warranty (servicing etc etc) and also had reported the problem at the earliest opportunity.After a lot of phone calls and visits to the repair depot(Ford)i was eventually told NO so i phoned the complaints number and was told by the the person that this has been a well known fault so each case is presented to a panel of ford top engineers who look at each case on it's own merit and they said no in my case but will not give me a reason.So that is the reason I'm doing what I'm doing,Oh and by the way the wheels have suffered not even a stone chip and have never been kerbed .

I never have, but I should have. They wouldn't pay for some warranty work on my Focus either....Man, good luck with that, it sounds like a long process!

I am assuming that there was a reason they denied the warranty, probally something you did. I am a Ford service manager, the last thing I want or Ford wants is to refuse a warranty claim and have an upset customer. I don't know the details of your concern but I am going to assume that the dealer is acting within the legal guidelines of the warranty at which case you will most likely lose in court.

Ford or any other manufacturer can and do refuse to honour warranty claims where someone has infringed the term and conditions.

For example if you used a non ford approved oil and the engine failed then they would be within their rights if it can be proved the oil did not meet specification.

Actual case I was involved in. Customer used cheap non multigrade oil,

Failure to have a vehicle serviced in accordance with manufacturers schedules.

Actual case I was involved with. Brake failure due to ignoring need to change brake fluid at specified intervals. They were also prosecuted.

None approved modifications to vehicle that result in failure.

Actual case I was involved with. Lowered suspension and fitted larger wheels.

Damage resulted for which Ford refused to accept liability; it was a motability lease car they charged the driver for repair and putting back to original specification.

All went to court and claims were rejected as they infringed the terms and conditions of the warranty. They are in the handbook if people bother to read it.

Got a long list for Ford and other makes in a similar vein.

i would take them to court for rust.
