You can get cold sores, which is a form of herpes, from kissing someone who has cold sores, but you can NOT get genital herpes from kissing someone.
Genital herpes is spread by sex (vaginal, oral, and anal) and by DIRECT skin to skin contact with the infected area. Babies can also be born with herpes if their mother has an outbreak during delivery, but, it's REALLY rare to be born with herpes.
Also, the person above me is just WRONG. Cold sores ARE herpes. Herpes simplex virus 1 and 2 are responsible for cold sores. Generally herpes simplex virus 2 is responsible for genital herpes, but it can also cause cold sores. Cold sores are not usually considered a STD though because the most common way of contracting them is by kissing someone who has them.

If they have a cold sore you can catch a cold sore. A cold sore is caused by the herpes virus.
It can be passed on orally or through sex with an infected person. There is little chance if the person does not have any physical symptoms. If they don't they could still have the virus at the surface of the skin.
But you can't have herpes genitally by just kissing someone.

I got clinically diagnosed with the herpes simplex virus (type 2) about 3 years ago, whilst I was still in college and had a foolish one-night stand. I know a lot of young women say this, but I swear I had never done that sort of thing before. HSV1 is commonly found in the mouth. HSV2 is commonly the cause of genital herpes.
You can get HSV1-herpes on your genitals if you receive oral sex from someone who has oral herpes. You can get HSV2-herpes in your mouth if you give oral sex to someone who has genital herpes.
You can get genital herpes from someone by tongue-kissing by this one possible sequence (there are other possible sequences):
1. You get oral herpes by kissing.
2. You give genital herpes by giving oral sex.
3. You get genital herpes by having regular sex with that infected individual.

if he has herpes simplex on or around his mouth you could get it from kissing him. Also, if he has herpes on his penis and you give him a ******** you could get it also. however, if he does NOT have it on or around his mouth you won't get it from just kissing him:)

Cold Sores CANNOT cause Herpes. The virus is very similar but one cannot cause the other.
Herpes is a nuisance for sure, but no big deal. In most cases it burn itself out quickly and returns rarely.
