i was n the navy for 4 years and 10 months. i singed up for 5 years. went to mass three times. i went to iraq for 6 months. this was last year. when i came back. me and my wife went to a buddy house. she got drunk really drunk. i dont like to drink. i dont like the taste of it. when she got drunk she told me she ****** my best friend when i was gone. i left and went home. late she came home to. she followed me to evey room for 2 hours. i was getting madder so i pushed her down. went to jail for 5 days. the da dropped all charges becouse she was drunk and i was not. 5 months later. i get called to legal. i was going 2 c the old man. he gave me a oth, re4 and kicked me out. the same week. a guy i knew sent his wife to the hospital. got charged out n town for. the navy gives him a general under honerable. can go n2 other braches. and get to keep his mgibill. the co did not give him any time. he was only n for 2 years. what can i do. i was a good sailor. my evals were top notch.help me

you had a history of going to MAST. not mass. going to mast three times does NOT a good sailor make. Domestic violence is a career KILLER..and you commited DV. you were sober, so you don't even have that excuse.

the CO decided to make an example out of you. now you get to deal with the consequences.

Sounds like the CO got it right to me. You went to MAST three times so that wasn't your only offense. Ever hear of three strikes and you're out. That's what happened to you. Don't forget you didn't belong to the District Attorney. You belonged to the US Navy. The Navy doesn't let you hit or push or do anything else to your wife and get away with it. You went to jail too, that means you were marked UA for 5 days. You were not screwed by the Navy, you screwed yourself. You aren't getting back in to the Navy or any other branch. Haven't you heard about the new Navy, they don't put up with this kind of thing anymore. If you want to blame anyone, start with your ho wife and your piece of crap best friend. Then look at yourself. Anger management would have kept you out of jail. Sorry dude, but you sealed your own fate. The other guy probably wasn't on the three time seaman smuckatelli list like you were. Who goes to Mast three times??? You did so the evals couldn't have been very good like you said because everytime you go to Mast you should be getting a SP eval. That isn't good in the Navy's book. There is no help for any of this. Hopefully you left your nasty wife and friend behind and have started a better life for yourself, but sorry the Navy is not going to change your discharge codes/reasons and let you back in ever.

First off, do you have any records that the charges were dropped by the DA. If you do not you need to get them. Second was the OTH and RE4 for the incident mentioned if so. You need to contact the VA and fight to get the OTH and RE4 changed. Present all of the records that you have to support the request of changing the OTH / RE 4. It sounds like a CO had it in for you.

Going to Captain's Mast Once, Twice and Trice! That is a pattern of misconduct and likely an OTH charge. You can petition to get it changed, but not likely.
Fill out the DD 149.

Its all in the CO's discretion, Ive seen a guy pop on a piss test and still stay in the navy no repercussions. Good thing for the zero tolerance for drugs. He told some story about getting drugged at a bar. No one is giving any free drugs to a guy. It just ain't going to happen. Then I saw a guy go UA from PT and get kicked out. Its all about who he wants to make and example of.

You went to Mass 3 times, plus the final incident.

Therefore, you WERE NOT a good sailor.
Also, If you lack the discipline and self control to not physicaly abuse a woman, no one can expect you to have the discipline and self control to handle the stress and rigours of military duties.

Heres a question for you, why didnt you just leave during the two hour period that you claim she followed you from room to room?

That is what a "Good Sailor" would have done

Bottom line, spousal abuse, you should have walked away, ou know you should have and you knew the consequenses. I am not sticking up for her, she was wrong, hell you could have divorced her and got away with not paying anything. You let your anger get the best of you. Oh, and you have been in trouble before, 4 strikes and your out.

why did you go to mass those 3 times IF it was violence related I would say that he had enough of you and that's why........I believe the local chapter of the American legion can help you out with a lawyer or at least point you in the right direction but I would think it is doubtful you will get anything changed..............

Something seems incomplete in your story...can't put my finger on it...you went to see legal and THEY gave you an other than honorable discharge???
