I had my car repo'd in nov 06. The settlement was way too much for me to come up with along with the payment plan. They decided to take it to court now for 9500 bucks. I would rather have them take it out of my paycheck then my joint bank account. Is that possible?? Would they go after my wages before my checking account?

They will go after your wages first

CA allows the garnishment of wages. The garnishment will be taken directly out of your Paycheck.

Your employeer will get an order to garnish and you will see it as a deduction on your pay stub. They will not garnish your wages until they receive that order. This could be anywhere from 30 to 60 days after the judgement was entered against you.

If you are at a fairly steady job they will probably go after your wages first. If the job is not really steady or you have had for a short time they might go after the account.

They will garnish your wages first....but if you have the money sitting in a bank account with your name on it, they have the right to garnish that account as well. It doesn't matter if it is a joint account or not, your name is still on it and you still owe a creditor money. I have seen many people have their wages garnished and then try to hide their money in another account that they hold jointly with another party only to find out the bank can take that money in a lump sum and pay it to the creditor.
