I carry my nkife when i go out just in case and this kid is gonna try me.

I mean not liek 1 punch on the arm.You can tell when there playing or not.and i nkow the kids not messing around.
The knife is nothing more than a fishing knife my dad bought me.
Its selfdefense the kdi tocuhes me i should have the right to fight back even if it does envolve stabbing him to step off

if you have a weapon and he doesn't you could be found using more force than necessary... and get in big trouble ... even though you were trying to defend yourself...kind of a crap deal

Yeah, especially since this kinda seems premeditated. I think unless he attacks you on your property, uninvited, you cannot stab someone.

And by the way, Kentucky has not decriminalized marijuana. Less than 8 oz is a misdemeanor that comes with a hefty fine (the stamp act) and up to a year in jail, and over 8 oz is a felony with the fine, but more importantly up to five years in jail. Over 5lbs, your facing 10 years.

The reason why you really can't defend yourself with a knife is because you probably have ways to avoid stabbing this guy. Your obviously a minor, go talk to an adult about the bullying. The fact that you carry a knife sounds like premeditation, and they would use that against you in their case of assault with a deadly weapon. I think the way you defend yourself has to be equal to the way you are being attacked, and sorry but being stabbed is not comparable to being punch. Save yourself and your family a lot of misery and time in PRISON and just leave the knife at home. Good luck, hope you make the right decision.

According to the strict interpretation of the law, yes. If a kid started a fight with you, unless you can argue that you believed your health, or life, to be in serious danger, you must gauge the response of your actions. A person cannot consent to injury, so even if they've just punched you in the head, if the injury you received, or the one you are likely to receive, could be described as trifling or passing, you have no legal recourse to resort to violence which could be construed as life-threatening.

Not to mention that, unless you carry that knife in plain view you are also technically carrying a concealed weapon. Sounds silly, but it's true.

Simple answer, avoid stabbing people.

Yeah, it's called assault with a deadly weapon. Self defense is a legal defense that your lawyer can bring up in court, but you are still going to be charged with the crime and a jury will have to decide if your self defense was legal. They will look at all the circumstances: whether you had a chance to escape, whether the self defense was excessive and leaned towards vigilantism (like that guy in New York that shot those muggers while they fled away...Bernie Getz case, I think)

your action would likely be called "assault with a deadly weapon" by the cops. It is a felony.

I am aware that there are bullies who start fights just because they think they can get away with it. And you do have the right to defend yourself, BUT you do not have the right to raise the ante from simple assault ['he punched me'] to a felony ['assault with a deadly weapon'].

Assuming you are yourself a minor, the juvenile court judge who hears your case may, depending on your age, record, behavior, and other factors [some of which we may never know] decide to slap you on the wrist, send you to jv lockup until you're 18, or even transfer your case to adult court with adult consequences [adult prison].

You'll have to find another way. Be inventive.

Yes, you will be in trouble. Only in a life threatening situation would the use of a knife be warranted. Otherwise you are going to be charged for using the knife regardless of who started the fight.

You carry a knife? Just how wonderful America has become. How old are you?

If someone hits you, why would you stab him.. why not hit him back if you must retaliate.

But don't worry, by the sounds of it, you will be dead in a knife fight very soon anyway.

Isn't it nice that our government allows us all to carry deadly weapons.

use a less deadly weapon like a chain or stick. no stabbing. or be a brave and fight with your fists
