Lets say I was in an accident where someone came over into my lane & hit me. It was their fault but their insurance company has not accpeted liability because their driver is telling a different story. Their driver is telling their company that I came over into their lane.
I didn't call the police. A mistake, I realize.
I only have liability insurance. Can my insurance company do anything for me? What are my options? If they are offering me 50%, should I take it?

You are absolutely out of luck. Tell me this.... if two people are both saying the other person crossed over the center lane... how on earth is a company supposed to know who is telling the truth?

They arent just going to pay you (not even 50%) because they have absolutely no proof their policy holder did anything wroth paying. So.. unless you have a witness.. police report.. etc.... you are absolutely 100% out of luck...

P.S. oh lord.. i knew someone would pull out the "lawyer" comment... did the lawyer see the accident? Now tell me... what exactly could a lawyer do here? NOTHING besides take some of your money. Lawyers dont magically cure something. No evidence= no payment

The insurance company is going to do whats in the best interests of the policyholder & the company. Now because they are receiving two different stories though it makes it a harder situation to resolve. Again claims adjusters are not lawyers, but negotiators. They do know the law but are not going to take the law into their own hand, most adjusters will tell you as well they cannot answer hypothetical questions. You should get a lawyer, but before really think did you hold more responsibility then the other guy for your actions. It might be a 50/50 but again you are the upset one..and he is as well.

1) Have them issue you payment for the undisputed amount of your damages.
2) Sue the driver in small claims court.

Liability decisions are based upon EVIDENCE first, credibility of the witness (drivers involved), and the insurance company will always stand behind their driver unless evidence suggests otherwise. No your insurance can't do anything for you...you said it yourself, you only have liability coverage.
