i am trying to get my exhusband served with a restraining order and he has been living with his other ex at her house and today when the marshall tired to serve him over there she came to the door and claimed that he has moved but does not know where. he is ducking service. if he did move she definitely knows where he is. he knows that without getting served the tro is no good and therefore he can continue to harass me and not go to jail. WHAT SHOULD I DO.? is my only option paying some a ton of money to stake out her house until he comes out?

The marshall must file a report of non-service so that substituted service will be made through registered mail or publication in the newspaper of general circulation so that the restraining order is deemed served on him even when he avoided being served.

You may want to check with an attorney to see if you can have it served by publication of service in the local newspaper. You can also possibly see if the documents can be served at his place of employment. As a final resort, check with his family members. Chances are, they might know exactly where he can be reached for proper service. IN all cases, I strongly urge you to consider getting an attorney to properly advise you what you next steps could be if service is not successful.
