Ok my husband and I filed for the EITC and CTC we have two children that live with us and are ours, 5 and 4 years old. The feds withheld the eitc but gave us the ctc money. Now their asking for the ctc money back and I have a 90 day letter of deficency now and have to petition the tax courts. My question is with the amount only being 2000 dollars should I represent myself?

Yes they disallowed the eitc and asked for proof. I sent it in.. it was disallowed again. I then received a 15 day letter I faxed in the information because I was told I could fax it instead of mailing and they said they didnt receive the fax which is impossible because I have a return fax saying it was received. So now I got the 90 day letter to file a court petition.

Did they say why they disallowed it? They must have said something. If the kids are yours, and live with you, there shouldn't have been an issue. If they didn't say why, ask them. Maybe it's something simple that can be corrected easily.

If you call and ask, and can't make them back down, I'd get with a CPA to see you through this.
