Wife (Chinese) went to a bank with husband who deposited about $ 4000 of travelers checks that were not used from a trip to China. The total in the account was then about $ 7000. At home she asks husband to send $ 10,000 to her family in China ( he had other accounts totalying about $35000) He refuses, then next day she haas him falsely arrested for assault. While he was in jail ( about 4 days ) she went to the bank and withdrew the entire checking account ( about $7000 ) it was a joint account but she never contributed any money into it, she was not working, and tried to take $ 40, 000 from a home equity line of credit but could not. She also used 2 credit cards from his account that he gave her to charge over $ 1000 worth of clothes, restaurant etc.
Would a jury consider what she has done in any trial for assault?

A spouse can't steal from a spouse while they are married (at least in Canada they can't). The husband will have to get a lawyer and he is entitled to half the money she took. This usually gets ironed out during the settlement. Taking money from a joint account whether or not you put money in there is not a criminal matter

Will it affect a jury's decision? Probably not. There is a good chance that the judge will not even allow this information to be admitted as it is not relevant to the assault itself.

Of course, don't worry all she did was in your favor. Hire a lawyer and get all the papers from the bank.

Once the court see all she did while you were in jail then you will be ok and she will go to jail.

There had to be evidence before an indictment was sent down for his arrest. As for the rest of it, obviously they were all joint accounts, so legally it's her money too and there is nothing he can do nor is it relevant as to whether or not he actually hit her.

Jurors are human. If they were aware of these actions, they would consider them even if the judge instructed them not to do so. A more important question is "Would the judge allow the defense to present evidence of these actions?"

If she hasn't left the country yet, she should be charged with perjury, thief , embezzlement, domestic abuse, conspiracy and I hope the Judge deports her. She is a gold digger.

.she is his wife so he married her for better or worse. and that's a little hard to swallow, as hes wife she has the rights, to take his money unless his assets are frozen by a lawyer
