Most lawyers will give you the first session free - especially if you are talking about suing. If this has happened to you I would investigate this possibility. If a lawyer thinks you have a good case, many of them will only charge you if they win. These lawyers take a larger cut of the money - but if you can't afford a lawyer something is better than nothing.
Personally I only know of one person who has been charged with assault causing bodily harm relating to engaging in sexual activity while knowing they are HIV positive. (A Saskatchewan Rough Rider Football Player - Canada) This person was convicted so I imagine the victims would have recourse - but the Canadian System operates differently than the American one.

i have heard of the one where the person was hiv posative/had sex with lots of people without telling them and he was given a jail sentence/if the person giving// has an std and does not inform partner then yes there is legal implactions/but /for the above reasons i am not sure and /maybe on what type/excatly the law is regarding std it may vary/u would need to speak to a lawyer/ very good question/i think now it may make more people think before they leap

There have been many. Not sure what the actual case is but I remember it something like this: A male with HIV, knowing he had HIV had unprotected sex with a bunch of women who then contracted the disease. He was sued for endangerment or something like that. Try google it and see what comes up. The women did win and if I'm not mistaken, the male was incarcerated. It was because he knowingly had the disease. Hope I helped.

I watched a video in one of my classes were a woman won against her husband in a case similiar to this. The video said that the only reason she won was because they were in a marriage... fidelity is supposed to be guarenteed... therefore, the responsibility to "protect yourself " during any sexual activity was thrown out the window, because a wife shouldn't have to use protection if her husband is legally supposed to stay faithful to her. I don't really remember what video it was or where the case was... but for some reason, I actually think that the wife, for some reason, withdrew before the ruling could be official for some stupid reason.

There was a case settled in England last year of a woman who had knowingly had sex and passed HIV on to her partner. She was put in jail, I'm not sure if he got any damages awarded though.

In CA, it is illegal to have sex with someone without warning them that you HAVE HIV or AIDS. This is considered attempted murder! Cases have been won, yes..........for these conditions.

I really don't think so. sex is risky. period. on the other hand, maybe. i suppose if someone knew they had hiv and went sleeping around, that could certainly be regarded as...criminal? huh... good question.
