If he is an illegal alien, then there is no such thing as common law marriage. Illegal aliens have no rights here and the law does not apply to them except to deport them back to their homeland.

Marriage will not stop deportation. My husband was just deported back to his country of England this past week. He was brought over as a child, went to schools here, and after we got married and applied for him - they tracked him and deported him. So I am paying for something his family should have long ago. And people on here saying all illegal aliens need to be deported are being ignorant to the fact that this country was based upon immigration. Your ancestors were once immigrants too but they were given the opportunity to make a life here. Some immigrants do ruin it for the rest of the ones who are being legit. That angers me more than anything. We will keep all the drug abusers and murderers in this frickin country but will get rid of good people who are just trying to live an honest life. You can't help who you fall in love with....and I fell in love with an illegal alien. And I am going to move to my husband's country....because I feel this one is based on lies. You are not truly "free" in this country. I was born here and so have generations of my family but I feel my rights have been stripped from me as well. So back to the question - no longer a "common law" for marriage. They change immigration laws every year and for years now, being married to an American citizen does not protect immigrants. People ruined that too by just marrying to stay in the country and then splitting from their fake spouse. Good luck with your situation.

The approval letter is for the I-130 petition. It recognizes that your husband is eligible to apply for an immigrant visa as the spouse of a US citizen. If it has been less than ten years since he was deported, then his application will be denied. You will need to pay a lawyer to file a waiver to lift the bar, so your husband can re-enter. Approval of the waiver is not guaranteed. If he has a clean record with no legal violations other than illegal entry, his chances of being approved are good. You will need a lawyer to file the waiver, however, if he's been out of the US less than ten years.

No, in 2001(?) they started going hardcore on some of the immigration laws. If you marry your husband and he wasn't legal in the first place, they can still deport him. They can also prevent him from coming into the U.S. for 10 years if he lies about not being an illegal. If he does it again a second time, then he can be banned from the U.S. permanently.
