He beat me up inside the car and as i was trying to get him off of me, i scratched him in his face.. when i arrived at the police station, my eye was swollen, lip busted, bruises on chest, side, and face. He had two scratches on his face and we both were arrested. Can someone please help me and say what i can do to get some justice.. i live in richmond, ca

I agree with Tenncopgrl's explanation. A police officer must take the information and try to decide who did what. Somewhere between both stories is the truth. An arrest is not a conviction. It gives both of you the opportunity to plead your cases in front of a judge and to have the judge decide. If you are looking for justice and your ex was beating you up, you need to do two things - 1st) Get yourself some help through a woman's shelter or domestic violence group so that you do not return to the abusive relationship. 2nd) Find an attorney who can help you plead your case to the judge.

You were probably both arrested because it was thought to be a mutual combative situation b/c you both had marks. Most states have protection orders available that prohibit an abusive person from coming in contact with you. Contact your local District Atty's office or Family Court for further direction. And good luck. Make sure that he STAYS an EX!

I guess the woman is just supposed to stand there and get hit. If she defends herself, she gets arrested. It's an INSANE law.
The best thing to do is NOT call the police. Just leave the guy as soon as possible.
Don't get the police involved. They're just empty headed robots.

it falls under the domestic abuse law. if you both have marks then you both go to jail

I know how you women are, my wife(miss jailbird) was arrested for something similar to what you experienced ...let us guys handle the situation of head of house....you will always have the kitchen!
