I have a friend that bought herself 2 puppies from the newspaper. The seller called today saying she wants them back because she sold them at the wrong price. Its already been almost a month since my friend bought them. The seller is harrassing my friend saying she is going to the house and taking the dogs back or my friend can give her $160 more and keep them. Can she take the dogs back if my friend doesnt give her more money? The seller didnt have them registered or anything she was just selling puppies her dog had.

Stupid to give them a dime to begin with.

Do not give them anything tell her to go........ She can take you to court or whatever because she should not have released the pups without full payment or a signed note as proof it was still owed funds.

No she cant take the dogs back nor can she charge you more. Its just like a retail store if they have a product priced at say $200 dollars and you take it upfront to pay for it and it rings up $250. You tell them that it said 200 they go check and your right they give it to you for $200 because thats the price they told you it was when you took it off the shelf. They dont expect you to pay more because they messed up. The lady sold the dogs to your friend at an agreed upon price no more questions asked. Then 1 month later she does the math or sees the same dog breed in the paper for a different price and figuers out she got screwed. Well thats her fault she takes the cut and thats all. If she doesnt leave you alone then I beleave a phone call to the local P.D. is in order fallowed by court.

the1st. thing that comes to my mind is whether or not this transaction was done legally with proper paper-work....was there a bill of sale and did the seller varify that the sale was finalized and the full payment was received.....the fact that they released the dogs to your friend does not constitute a finished sale, if the buyer had agreed to future payment down the road at some time....i hope that your friend was smart enough to get the sale on paper with a "PAID IN FULL'' AND SIGNATURE from the seller.....the seller could charge that your friend took the dogs under false agreement to make additional payments.....I doubt that the seller would win such a case in small claims court....if they do not have a signed agreement either.....The court may rule that the seller was foolish for releasing the animals before the final payment was made and negligent for not putting the transaction in a legally binding form with proper paper-work.....in the meantime, tell your friend to tell the seller to go to small claims court and that whatever the judge deems, that your friend will abide by the dicision.....either pay the extra $$$ or return the dogs and recieve her $$$$$ back as a refund....your friend should then appeal to the court in a counter suit for her expences that she incurred sheltering and feeding and getting the dogs proper medical treatment and their shots......good luck to your friend,I hope she kicks the sellers butt in this situation.....In new york ,where I live, there is a law to prevent this type of thing from happening....it's called " THE BAIT AND SWITCH LAW"..... it prevents sellers and vendors from baiting you into a sale and then changing the price after you commited to the purchase.....maybe there is the same law where-ever you and your friend live....damn! it P---es me off how some people are always trying to get over on innocent people....

No way. That is so weird. If the person keeps calling have your friend file harrassment charges, also make sure she has a copy of the ad which states the price she paid initially (if she doesnt still have the ad have her contact the newspaper to get it) I wonder why the seller wants more money now? Nutso!

Sounds to me like she doesn't have any proof she sold them anyway without papers. As long as your friend has proof that they are her dogs and she has been taking care of them then that's enough. The seller doesn't really have a leg to stand on. But she should not give the seller additional money. If the calls continue call the police and report her for harrassment or bring up small claims court. Most people back off as soon as they hear small claims court.

She has no legal case against your friend. Your friend should keep the dogs and ignore the woman (but don't erase phone messages and such, should she need them if she has to go to court). If the harassment gets out of hand, get the police involved.

Did you friend pay by check or money order? If so, cashing that payment is an acceptance of the payment at the price paid.

If your friend paid cash, it's a little harder to 'prove' unless you have a receipt, but a verbal contract is still a legally binding contract. If you friend gave the person money, and the person gave your friend the dogs in return, then it is a binding agreement.

Tell the seller to take it deep, its just like any other transaction. Its complete, its over, if she lost money then too bad for her, she should have thought about that prior to selling the dogs. My friend recently bought a car and he went back the next day and the sales manager was saying they didn't sell it for enough, guess what, they didn't take the car back.

If the seller sold the pups with the understanding that they were paid in full at the time your friend bought the pups. The selling can NOT come back asking for more money.

I breed minpins, and quoted my first pup for $450 then realized that I was losing money at that price and my price and raised it to $600. I still had to sell the first pup for $450 because that is the price that I had quoted the woman. The other puppy in that litter was sold for $600.

Your friend has had them a month. This sounds a bit fishy. She may want to call the paper where she saw the ad and report this woman. You can't sell puppies or anything for that matter take the money and then want more weeks later. Hope this all works out. Good luck;^)

Tell your friend to keep the dogs. The person she got them from can't legally do anything about it now, unless she can somehow "prove" that your friend stole the pups.
