Sales assoc. told me to give $500 deposit & they would get a certain car for me. They didn't have the car I wanted on the lot so they were to dealer trade one. I was told that their were plenty of the the type of car I wanted. I waited 4 days and was told that they were having trouble locating the Honda Cr-V EX that I wanted, but would I settle for an EX-L or LX model. I told them no and that I wanted my deposit back. I was told before I gave them my credit card # that it was a refundable deposit. I seem to be getting the run around. After I told them I wanted my deposit back, they tried to get me to give them until noon the next day to try to find something. I said No, I just wanted my deposit back. I said I wanted confirmation that my credit card had been refunded sent by fax. The sales assoc. said OK and give him a few minutes and he would call before he sent it. I waited for 2 hours.Then they told me the lady who knows how to refund my credit card had already went home.

This is very simple. They cannot keep your money. If you don't have a contract, then they have no right to hold on to your funds. If you do have a contract, then they have to follow through with the type of car that you agreed on or they have to give you a refund.

In reality, this is not about the $500. This is about them not wanted you to go to another dealership. They figure that as long as they have your money, they have eliminated that possibility. They figure it's a waiting game and after a while you will want a car so badly that you will take one you didn't originally want.

I would call your credit card company and tell them not to pay the $500. If you dispute the charge, the dealership cannot invoice the credit card company for the $500 and you are all good.

oh you bet you can get that money back, did you sign a contract? If you did you have a smalls claim court case you can bring them to, that is done threw you local town and sue them for any court fee's, also call your bank and tell them they stole your monies and want to know how they can help you get it back as they have no problem calling this fraud, after all when you have a cc the bank will do and investigation and shame them into paying it back as the bank can do serious damage to this dealer. Start with calling your bank then ask them if they can help and if you should file a small claim form threw your local police dept. oh I hate dealers like that and boy the damage you could do to them and also if you really ticked off, make a sign (as I have seen this before) place it on you trunk of the car saying " such and such care dealer steals monies from you don't buy there" and believe me I have seen this done and when I saw this car with this big cardboard note taped to his trunk really made me think. He made his point and I bet he got what he wanted. Good Luck

What dealership were you at?! I've never heard of putting down a deposit to get the car you want. Legitmate dealerships are in the business of selling cars, not "guarantees." If you tell them you're interested in a particular car, they'll get it for you without you having to grease their palms first.

This sounds VERY shady! Especially with the runaround you're getting. Do NOT give up trying to get your deposit back. If you must, contact the Better Business Bureau. http://www.bbb.org/

Yes you are due your money back. I would recommend a visit to the dealership to request your refund, make sure the salesman is in and demand your money back. They can easily blow you off on the phone,but in person they need to address the issue. Good Luck

Yes they cannot hold your deposit. I work at a car lot.If you have not taken delivery they must give it back. They will however try to sell you ,but have no choice but to refund the money.

sounds like you had all your ducks in a row, and they didnt produce the car.
they admitted you would get your money back, and in doing that, agreed they had enough time to find
the car and didnt..keep trying......
