Yes, I had a friend that got a dui when she was in someones house drinking a beer. The car was locked & the keys were in her purse. The cop was just being a jerk, but it cost her lawyer fees to have the charges dropped. The cop didn't even know which car was hers in the parking lot. MONEY is the factor - not safety & don't let anyone tell you different.

Yes. Case law shows that having your keys in the ignition while you're in it, even if you're passed out, shows that you are in physical control of the automobile -- one of the key elements to a DUI. If you're going to pass out in your car, take the keys out of the ignition. Then you will be praised for doing the right thing . . . not driving while drunk.

yes you can, a word to the wise.
If your keys are in the ignition you will be charged whether you are driving or sitting there.
If you pull over to pass out, sober up long enough to stash them somewhere outside of the car . Just dont forget where .
A dui charge sucks if you arent even driving and the engine isnt even running .

Best to put the keys on top of the tire, and pass out on the ground. Much better than getting behind the wheel and putting everyone at risk due to your stupid behavior. You're better off if the cops catch you driving drunk than if I do!

NO!. The violation is: Being in physical control of a motor vehicle while under the influence of alcohol, drugs, etc.. This is a subsection of the DUI laws, and the keys do not have to be in the ignition, you just have to be in control of them.

Yes! As long as you are behind the wheel and inebriated, you can arrested for DUI.
Your best bet is to hide the keys in the bushes, and sleep in the back seat of the car.
Although you may still be arrested, it will be harder to convict you.
