If the Dr prescribe this medication for you to take daily as ordered by a Dr I am not seeing how they can withold anyone's medication as longs a Dr ordered it and states withdrawal from this medication can result consequences this would put the police at risk for refusing to turn over medication you are legally entitled too. Especially if you are released from jail on bond the police have a responsibility to return any medications list in your name. Stopping a med like this can result in death after so many days you will suffer the severity withdrawal symptoms and the police not be responsibly for the well being of the jailed inmate. Would this also apply if the police were holding this medication for evidence does this mean they can bring medical neglect to someone charged with just a DUI and watch the person suffer.Again this reminds me of police Practicing medicine without a license. IN all fairness the police also have rules, rugulations they are expected to comply with and are accountabilty for the choices they make. Arresting a person does not put the police in the position stop medications from the minset they don't like them. From many of these answers many here would watch the de denined the meds and die with no chargres brought unto the police. Why do many of these people here a want legal system based on what the cops say. No this is not the way American is ran. We atre entitled to trail ang not subjected to the whims of the poice

Xanax is not an illegal drug if it's prescribed. However, it is listed by the FDA as a controlled substance, and nearly every state has adopted the FDA's definitions of controlled substance. That means even if you have a prescription for Xanax, it is still illegal to drive under the influence of it. It is probably being held as evidence until trial. However, if you have information that jailors or police officers took some and put the rest into evidence, then you need to report it to another police agency (such as the state police). They will investigate the matter and ask that charges be filed if there is any merit to the report.

You need to contact the prescribing doctor immediately and tell him/her. The pharmacy will not give you more controlled substance drugs because it's too early for your refill according to your dosage. Only your doc can change that by giving you another prescription.

I'm certain you realize that you are not supposed to drink enough to be drunk when you are on a controlled substance!!!!!!! Not only is it stupid, it's stupid, stupid, stupid. Then again, any DUI is. Maybe you should consider that your drinking may be part of the problem causing you to be on Xanax in the first place.

I would go to a pharmacy and tell them you lost the meds and ask for new ones. Then file a complaint with the police chief or sheriff, the top cop of the Dept that arrested you. If you don't get results in a couple days contact the newspapers or write a letter to the editor and follow up with another complaint. They are going to lie and say that they misplaced them, that's the cop standard. Mention the dangerous cold Turkey part and hint of a lawsuit, that gets attention from top cops.

Bro, I had the same thing happen to me. I was arrested for driving under suspension and had my meds with me. I take 6 different meds including Xanax and oxycontin and Percocet. I had a brand new refill of percocet (360 pills) and when I got out 12 hours later I only had 300 percocet. I complained and got no where. They just denied it.

Just because your precribed a medicine doesn't mean it's safe, or legal, to drive while you're taking it.

By the way, you won't end up in the hospital from not taking XANAX. My wife had an addiction to it and cold-turkeyed it. It can be done.

Its quite possible that it was inventoried and put into the evidence room after the arrest. Check with the department and if you have a legal prescription they will probably release them to you if they are not part of the investigation for the DUI

That would be an extremely hard one to prove. You definitely want to file a report though. Just in case others have had the same problem.

There really is nothing you can do. Police do this all the time, and there is no getting around them. Hell, when you get out of prison, your supposed to get back all the stuff they confiscated when you went in, but normally most of it has been stolen by one of the wardens. Sorry to tell you this.

Was it in the correct bottles, ? if they were in marked bottles you can file a complaint with the department

If they were just in a baggie or a unmarked container they would have most likely just been thrown away.
