Gosh I hate smokers! I wouldn't arrest them but I would give them a big piece of my mind.

First of all the only way that you could make a citizens arrest is if you had reason to believe or knew with out a doubt that the person was committing or was about to commit a felony. ANd I don't think that smoking in a non smoking area is a felony. And most likely he would be able to sue you for false arrests, and I think that can come with jail time. So, next time remind him that he is in a non-smoking area, and if he doesn't stop then call the authorities that are paid to handle it on him.

Depending on the situation it's not a felony to be smoking in a non-smoking area. Because of the way most state laws are setup you won't have the right to arrest that person. In most cases citizen arrests aren't taken very seriously by the legal system. If you have a big problem with it talk to the owner of an establishment or call your local police station (non-emergency number).

dude its a civil infraction! If you tried to "civil Arrest" him and he beat ur face in the cement he'd be free and youd be in jail for assault you think you gonna make yourself a famous hero for this?! Leave it alone the polution in our air is more threatining than 2nd hand smoke
