well it would be considered when judges always act toward a certain ideology no matter the case. the ninth circuit court is considered to be an activist court. they will turn over any law that seems to be leaning to the right. have struck down laws voted on by the people and passed by legislative. also was the court that ordered the Pledge of alliance to illegal for the words under God.
