I went on maternity leave on March 22 and had a c-section on April 12th, i thought the entire maternity leave was 16 weeks maximum. My employer is now telling me that i will only have job security up to June 14th. 16 WKS is in July. Could someone explain this? thanks!

I live in California and have been on maternity leave. You get 8 weeks disability following a C-section, and then you have 6 weeks of paid family leave (if your job qualifies, you have to be there 12 months, and have at least 40 employees). Even if you dont qualify for Paid family leave, they have to hold you job for 12 weeks total. Counting from March 22nd, you would have 12 weeks which would end on June 14th, so your employer is correct.

In CA you are entitled to 4 months on the Pregnancy Disability Leave act and an additional 12 weeks on the Family medical leave act.

To get the 12 weeks you have to have worked in the State of Cali for 1 year strait and worked at least 1,250 hours preceeding your pregnancy.

The four months is based on your doctors request and neither are set for small businesses. There is a miniumum # of employees the company has. It doesn't matter what the company says in their hand book, they have to follow state law.

i'm pretty sure maternity leave is 3 months
