I was driving an SUV they gave me a stratus can I get a free upgrade an submit this claim to the other party's ins. co.

The insurance company must provide you with a comparable vehicle. A Dodge Stratus is not comparable to an SUV. But then again, it depends, how old is your SUV? Is it newer? Is it a 2 door or a 4 door SUV? How many seats does it have? There is case law available that supports that you are entitled to a comparable vehicle. If they refuse to provide it, you can always threaten small claims to get reimbursed for the difference. If the insurance company is reputable, they will increase your daily allotment so that if necessary you can rent an SUV v. stratus.

If you weren't at fault the other driver's company should be providing you a rental vehicle anyway. You shouldn't have had to rent one through your own company.

But alas, you did. After your rental period is over and you are reimbursed from your own company, I would then take the bill over to the at-fault party's company and ask for reimbursement from them as well since the carelessness of their driver was the cause for you needing a rental in the first place.

You cannot collect money from both insurance companies. That is called double dipping and its against the law. Depending on the state you live in you may not be owed a comperable vehicle but only basic transportation

Yes. The other driver's liability carrier may have to pay your claim. But they don't have to pay bills as they are received. You have to figure out what your claim is and make a demand for settlement for the full amount of your claim.

I don't believe so. The rental car service is through your own insurance....I don't believe insurance companies provide this service to the other party.
