if a waiter spat in my food I would have knocked him out. Why would you even ask if you should report it.

Yes, you should do something about it. The waiter was rude, crude, and professionally unacceptable in his lack of "smarts". To say what he did about the lobster-he had no right to say. The more important thing tho-is the spit on your food. And the fact that he said the manager was not available. With the bacteria from his spit, you don't know how healthy he is. Nor do you know if someone were to do something like that (not to scare you), but hypothetically, if a waiter had HIV or AIDS, or some other std, or TB, and spread it to a customer with spit, that would be a complete reason for a lawsuit. In fact, you may want to contact an attorney about this matter, get his/her opinion on this. Also, please call your local health dist. office, and report how unsanitary this situation was. See what advice you get first. Instead of just calling the restaurant to talk with the manager, you could send a letter, addressed to the manager, marked "confidential". And, when you ask for this information, please give no clue as to why you need this information-the name, address, etc. So in case that waiter were to answer the phone, he wouldn't know what it's about. Also, do you by any chance know the name of the waiter? That is an important piece of information to have. Plus the date, and approx. time this matter occurred. I truly wish you the best on this. well from what your saying it sounds like you all finished your meal so it must have been ok, also how could your children be traumatized, nothing wicked or dangerous or disturbing happened, just tell the kids that there are some rude people around and not to bother about it, it is too late now to do something you should have gone back the next day or phoned, if there is a website you can email but it really is one word against another now.
i would just keep away from now on

You should absolutely report the waiter! Even if he didn't spit on your food he was rude and unprofessional! Furthermore I'm sure there was SOMEBODY available that you could have spoken to. He lied about that. The owner/manager of this restaurant has the right to know if an employee is acting like this. It could put them out of business. Now if the owner/manager fails to respond properly THAT is a different story!

You still ate it? Yes, report the waiter. What kind of a vegan is going to work at a restaurant that servers meat. I have a vegan friend that will not touch a leather wallet. I'm all for standing up for what you believe in. But putting yourself in that position doesn't make sense, It would be like a vegan working in at Saks 5th ave, sells you a fur coat and then throws red paint on it. He needs to work at jamba juice.

whoa, whoa, whoa, you ate the food.. o hell nah, i will have him in the unemployment line, get that dude man. he had no right to even make a comment like that regarding the lobster. I would call up some type of inspection on that restaurant. You never know if they really did spit on the food or if they do spit on peoples food regularly. Remember, your the guest and you pay damn good money for it, therefore you need good service. A restaurant stays aflot because people like you and I, we choose to give them a chance to serve us.

well Mr Blair, given your esteemed status, I would have insisted that someone representing management be sent to my table immediately to inspect the loogie. I then would have marched my family out the front door, and headed to the nearest greasy hamburger joint to toast the vegan waiter with a giant beef pattie or three.

Absolutely do NOT let this go - don't let that cretin get away with that. What a load of s***...If he doesn't like serving meat and seafood, then he shouldn't be working there. Even if the shiny spot wasn't spit, he still made the rude comment. I hope you at least got his name.
Ideally you should have asked someone else if they could get you a manager - but no doubt, I would have this guys job.

Yep, you should! I don't see this as your attempt to go against the vegans in this world. That is vulgar and disgusting! I would have left immediately and not paid for any of the food or drinks. I would have also asked a hostess (if there was one) or another waiter/waitress to speak with a manager, that it was an urgent situation. That makes me sick, go do something about it!

If this is a true story, you should let us know the name of the restaurant and the city in which it occurred. You wouldn't want us to have to deal with this same waiter.
