i retained a lawyer for a pedestrian accident in which i was hit by a car but my automobile insurance med pay kicked iin and i didnt know my attorney gets 75.00 out of 1,000.00 can i fire him on my med pay because he hasnt filed suit yet in my accidet

well the reason i want to fire him oon the med pay is i dont feel he should be getting anything because i pay my car insurance each month not my attorney and i ned the money to pay my hospital bills

i had accident once and i fired my first attorney and retained another, i just had to write a letter stating i know longer needed their legal services, you don't have to tell them why, just make sure you send it certified mail and you will get a copy where the lawyer signed, then you take that letter with you to the next lawyer you hire, he will have to keep it on file showing you are without council because you can't have 2 lawyers hired for same thing. good luck! and know dn't do it alone.

I've previously answered your question on a seperate post but let me continue to address it....

You can not fire your attorney on the Med Pay alone, he is looking to get money off you from any avenue possible, and this include your Med Pay. Your lawyer doesn't pay your hospital bills, or any other bill for you....ultimately that is YOU responsibility. However, your Med Pay will pay your bills up to your limit on your policy and the bills are paid on a 1st come 1st served basis. By now your attorney has notified all of your health care providers NOT to bill anyone but to send the bill to his office. He is interfering in your bills being paid....the hospital can and will send the bill to collections if it isn't paid and they don't care if you have a lawyer or not. So for example, if the hospital bill is $10,000 and you have a $25,000 Med Pay limit...obviously this is more than enough to cover the bill however your lawyer is holding onto it until you are done treating to submit any bills to your insurance carrier and the bill won't get paid until then. My suggestion to YOU is to get a copy of every single bill you have incurred from your health care providers and submit them to your insurance carrier on your own. However, if you have signed any form with the attorney's office assigning your benefits over to them the insurance still has to send the money to your attorney.

Your lawyer won't file suit on your accident unless the insurance company won't give him what he wants (not what you want). Although your lawyer has an ethical obligation to pass on ANY and EVERY offer of settlement to you for YOU to decide to settle on the amount I have yet to find a lawyer who actually does.

So if you're going to fire your attorney...just do it and handle this yourself as you are more than capable of doing so on your own.

well l would start looking for another Lawyer lf your not happy with the one you have.
