The police investigated the area where I parked and it turned out to be public property. She had almost 20 feet of area to park but she left her car backed up against mine for me to see when I came out to move my car. I said she couldn't do that and she said she could because it was on her property. I believe she hit my car intentionally because otherwise she wouldn't have just left it there for me to see and then tell me it was my fault. The cop said I might be able to sue her homewoner's association but I don't understand that. Anyone have suggestions as to what I can do?

Get your insurance company involved immediately. They should handle this for you. Explain everything to them and give them a copy of the accident report, if one was filled out. (There should be one since a police officer came out. If there isn't, contact the police and ask for a copy of the incident report.)

Your insurance agent can tell you how to proceed.

Since there was a reference made to a homeowners association, I assume the incident took place in something like a gated community or a planned community. In those places, most owners pay a HOA fee, which covers different things like maintenance of parking spaces or green spaces, or snow removal, etc... I think what he meant was you could sue her HOA because she broke the rules by causing an accident on purpose. Whatever the case may be, just let your insurance handle it.

If your insurance doesn't jump right on it and start negotiating with her insurance, try and find yourself a lawyer who will take payment on a contingency basis. That means that he or she will only get paid if you win your case. Explain in detail what happened, and that your insurance company is not handling things, and they should be able to help you out.

Hopefully, you have insurance, even if it's just liability, ask them to find out who her insurance is, I assume you have her name or at least her plate number, they should be able to find out from that. Then, file a claim with her insurance Co. ask your insurance co. to help with that also, and get your money. Or you could also sue her in small claims court for the damage if it's less than some amount,, sounds like an easy win.

Even if you were ILLEGALLY parked on HER property, if she hit you, she is at fault. I don't understand suing the homeowners association either. She is the one that should be sued. Get YOUR insurance company involved. They have more experience with this than everyone on Yahoo combined.

if you car was LEGALLY PARKED and another driver hit it for whatever reason they are automatically at fault no questions asked. This is what insurance companies thrive on. Sounds to me like she is trying to pull a fast one get copies of the report take it to your insurance companioes (with pics of both cars) and let them go at it.

It doesn't matter where a motor vehicle accident happens, it's still an accident. File a police report and contact her insurance company. Hit her where it hurts, in the wallet.

Sue or do somthing to get paid for damages casued to your property. Obviously it is her fault which you stated she really has no defence to use becasue she hit your car there is never an excuese to hit anothers car.

Take her to small claims court. If she damaged your car it doesn't matter whose property it was on...she hit your car and you weren't even driving! Dont sue her association, sue HER!

The police should be able to arrest her for malicious destruction of property.

If she did damage the homeowners has nothing to do with nothing, you can sue her for damage to your car if she hit your car with her car. ( does not matter if it was in her yard) if she hit you, she is at fault.

You can sue her in small claims court.

The best thing to do is refer it to your insurance company. They hire packs of ruthless lawyers for just such an occasion.
