I'm going down the main street and there is this guy we see. He is going out of the resident neighbor hood. He attempts to stop but once we are 10 feet away from him he tries to turn right away. This crash happened on the border of two cities. The cop from the other city says that we should pull up on the fast food restaurant. We wait 30 min until the other cop comes. He spends only 30 seconds talking to me. He talks to the guy i crashed for like 5 min. BTW the man was like a foreign guy that was from Jamaica or something. He tries to make it look like it's our fault by checking his car over and over again like we messed up. At the end the , the cop says that we rear ended him. Should i sue?

I hit the side of his car because he was the one turning. Also the cop before him knew that it was the jamaican's fault.

Not sure where you live, but technically-anytime you hit someone fromt he rear it will alawys be your fault, no matter what the circumstances! It sucks I know, I was ticketed for a similar instance, in fact the person I ended up hitting had no drivers license no registration for the vehicle and no insurance-which in louisiana is required by law-anyway, no matter how illegal they were, I was written up to be at fault, because I hit them from behind!
You can sue, but make sure you find enough people who saw what happened, other than the people who were inside your vehicle or the other persons! But honestly, you will probably end up spending more money on the lawsuit and lawyer fees than you would ever get if you were found to be not at fault!
Sorry, it's just how it works! Technically as far as the law goes, if you hit someone from the rear, it would be your fault because you are responsible for keeping a safe distance between yourself and the other driver and for watching out for what the other driver is doing. Don't shoot the messenger, I just know from personal experience!

Your description of the events does not provide anywhere near enough information for the reader to gain a clear picture of what occurred. The officer most likely spent more time talking to the other driver because he wasn't fluent in English.
However, to answer your question, you can sue anyone for anything. Whether you will win or not is a different story entirely. I suggest you seek the advice of a qualified attorney that specializes in motor vehicle accidents and personal injury.

Well if you sue, you really have no case, and I only say that because the cop said you rear ended him, so the cop's log says you are at fault.

Have you called your insurance company? Did they find you at fault or not?

If you were to sue, what would be your basis?

The attending police has allotted blame to you . You are not in an easily proven area because the police said you rear ended the other car . Only if you have independent witnesses could you say different so just wear it and put it down to experience.~~

If you hit him from behind, you will have a hard time proving that you aren't at fault. Even if he is driving erratically, the drivers behind should be far enough back to be able to avoid a collision. Good luck.

You could see if any stores around had someone who saw the accident. You can deny what the cop said in court though I would try to fight it but I wouldn't sue.

Unless you live in a no fault state, you hit him. A driver is supposed to have control of his/her vehicle at all times. Even though he cut infront of you, you still hit him. Sorry for the news.
