...but where do I go. I said to please pay me within 10 days or I will have to find someone who can help me take action. I can't back down from this. Does anyone know the best way to solve this? Labor board or lawyer? Magistrate? He always writes checks knowing that there is no money in the bank. Several employees, including me, have had bounced checks before. This is outrageous!

I have called the bank SEVERAL times and he has put a hold on the account. He will, basically, pay me when he is ready. He can't do this, but he has been doing it since day 1. I did some photo copying today, a bounced check, uncashable check, statement from the bank, and e-mails I have sent to him demanding my money...etc. I am almost ready to send them all to the labor board.
I feel that I should send the papers to the labor board and another place, but I don't know where. Do I need to?

This is normally done by the local police department. You will need to bring them the check and verification from the bank that the check bounced. They will take it from there. I doubt that they will be able to get you your money, but if all checks out they can get an arrest warrant for your employer for deliberately issuing a check with insufficient funds to have it go through.

1. Get your resume polished up and send it out.
2. Call your local police department to find out how to file fraud charges against him. If he is knowingly writing bad checks, he is breaking the law. You can use this as very good leverage to get him to give you a good check. If he mailed you the check, it is even better because then it is also mail fraud and a federal violation.
3. Go to his bank (or call every day) to find of if the check will clear. They will tell you over the phone if there are sufficient funds to cash the check. If there is enough money, cash it immediately at his bank. DO NOT deposit it in your bank account unless you enjoy paying Non-Sufficient Fund charges.
4. Use your resume and get out as soon as you can.

Good Luck!

Maybe you should talk to some of the other employees and all of you should go see a lawyer together. If you get enough plaintiffs you might even be able to find a lawyer that will take your case with no money out of your pocket. Of course you will have to pay him a percentage off the top of the settlement, (if you can get one). But you will have a much stronger case as a group, then as a single person. The amount of money gets bigger with each person that joins the group and as we all know, money talks.

Go to the labor board for your state. I am assuming you have been going to his bank to try to cash it? You may want to try to get something in writing showing that you can not cash the check. The Labor Board will definately be able to help you!

You need to cash your checks at a currency exchange, or a liquor store there is a small fee but at least you will get your money. Its usully around a 1% charge. Dont wait to long or the check will go stale.
