My cousin is in Valdosta State Prison and his mom which is my aunt passed on April 14, 2007. Does anyone know where it states it in the law book for the county to pick up her son to attend the funeral. Please Help. The county saying theres only one deputy to go pick up her son and he refuses to go.

Please help me solve this situation!

I believe the permission to attend such an event would be based upon which penal system an inmate is located in.

Since your cousin is located within the state system, he may need to obtain permission to go throught the State Department of Corrections.

Unfortunately, the only advice I can give you, is to consult a good
lawyer. From what I know, in general, the prisoners are not allowed
to attend the funeral of their relatives (mother/brother/father/child).
And, somehow, on good reason: after such an event, their moral
tends to collapse; they become even more depressed/desperate.

To my knowledge there is no law that states law enforcement must transport an inmate to attend a funeral, despite how close the relative is. We may do it as a courtesy but if the inmate is a risk I have no obligation to put society at risks by giving the inmate an opportunity to flee.

And if you does not want to go we can not make him.

Sorry. It's entirely up to the jail if they will take your cousin. Your only other option is to appeal to the judge in his case. Explain the circumstances and pray. It also depends on what he's in for. If it's a felony, forget it. It's not gonna happen. Sorry I couldn't give you better news, but I will pray for you.

Sory to hear it, but unfortunately if they don't have the manpower they are under no obligation. People in prison do not have "rights".

MAYBE THE DEPUTY SHOULD SUCK IT UP AND GO AND PICK HIM UP. YOUR COUSIN HAS THE RIGHT TO GO TO HIS MOTHERS FUNERAL.
