Probably not. If you had an attorney handling the case that you trusted and communicated with, you wouldn't be asking that here. If you go into this without a lawyer or with one you can't communicate with, you probably couldn't prove the other guy was even there, let alone at fault for anything.

unless the person is wealthy I wouldn't get my hopes up. Sorry for your loss.
Even if you win, youy might get a judgement, but if the guy is broke it won't matter. Call a lawyer, best of luck.

it depends on the situation, if they were intoxicated in any way, than more than likely yes, but if it was an accident, thats hard to tell, Good luck to ya!
