If these are credit card charges you are talking about, then yes they are legal.

The OFT made a ruling last year, and set the cap on the charges at £12. Anything above this charge from the past 6 years can be claimed back, but charges of £12 and below can't be. The credit card companies have now all set their charges to £12, which is the maximum they can take.

For bank charges, because there is currently no ruling in effect (the OFT were due to make a ruling on this this month, but decided they needed more time to look into it, so postponed it for 9 months), the whole amount can be claimed back.

My site below has full and detailed guides to claiming your bank charges back, along with template letters you can print out and send to the bank.

They're not legal and you can't get out of paying them but you can claim them back, the same with all sorts of bank and credit card charges. Go to www.consumeractiongroup.co.uk for more info.

if you have failed to read your contract with the amended penalty charges that is up to you.

These charges have been heavily reduced as they used to be double that!
