The maximum penalty for threatening death is between 18 months and 5 years in jail (in the Criminal Code of Canada) . It would really depend on your record and whether or not this was domestic related. If you don't have a record, chances are good that you will get probation with conditions that you keep the peace and not communicate with the person you threatened. There may or may not be a fine involved.

You try to make a complex issue a black and white item, well it's not. There are so many things that go into even this. Did you really mean the threat? Did you make any attempt to carry it out? Was the person really frightened from your threat? Did the other person make a police complaint?

If the police didn't actually hear it themselves they cannot do anything on their own. The police need a witness to make a complaint to them before they can even ask you a question.

As I said it is not just a black and white answer.

Assuming they have hard evidence (otherwise it's just a he-said, she-said type thing)...
I have no idea. I doubt you'd go to jail or be fined, because it's kind of a domestic thing and they would probably tell whoever it was against to just get a restraining order.

However, if you do get in trouble, your best bet is probably to site mental instability at the moment you made the death threat. That always works.

Alberta should throw your violent butt in prison...and keep you there until they're sick of looking at your sorry face.

Get lost.
