My girlfriend will give birth to our first child later this year. She is Estonian and she will give birth here. I know that I can get American citizenship for the child, but that will nulify his Estonian citizenship, which would disqualify him and his mother from getting one year's salary, under the "mother's pay" law they have here. If I wait a year to get him American citizenship, does it still qualify as Citizen by birth? Thanks for any help!

i hate to be rude, but those of you that know something, i VERY much appreciate your help! those of you that don't, why bother posting? the reason i think (know) my child will get citizenship is because I'm a citizen....i would notify the embassy and apply; not that big of a deal. it's just that by his being estonian for a year would allow his mother to earn a year's salary while she cared for him.

If the child is born here than it has citizenship. Also if the mother is Estonian you should think about applying for duel citizenship for the child, this way the child will be a "legal" citizen of both area but will not have to give up his/her heritage. By 'here' do you mean the US or Estonia?
If you mean Estonia, you are supposed to apply for your child's proof of US citizenship as soon as possible. However, many people wait for months or even years before they get around to it. You will not risk the child's US citizenship by waiting.
US citizenship will not nullify the child's Estonian citizenship, but Estonia will not recognize it; while he is in Estonia, he will be considered only Estonian.

as far as i know....the child will have dual citizenship. they can't take his nationality away. he should have every right as every other child there. It is only if she gives up her citizenship to become a US citizen. They can't deny care for a baby, i would talk to a lawyer.
My husband is danish and i live in Denmark. As far as i know around the world that is the way it is. and congrats on the baby, we are also expecting soon. my baby will have both citizenships. I believe its only those who are pure estonians, whose parents are both estonians cannot have dual citizenship. call the embassy

Get a lawyer who knows immigration. You want to bet your kid's citizenship on advice you get here? How much money are we talking about from Estonia, anyway? Talk about selling your birthright...
BTW, she's your girlfriend not your wife. Why do you think the kid is eligible for American citizenship?
