she owed 1300 and has paid me 200 so far. We have had a falling out and not sure if she is going to keep paying. On the contract I signed it has my name but the address for the bills to go to is hers, is there anyway I can get rid of this debt from my name to hers.

From reading your statement it sounds like your friends name is not even on this contract. If that is true? You are stuck with it.

I hope you have a separate agreement in writing with your friend stating that she will pay this bill. If not you are S.O.L.

Call the phone company and put a hold on the account and have the phone turned off if you have not already. Then see if they will settle for a lesser amount and pay it off as soon as possible.

If she wont pay you then file a small claims court case.

That her address is on the contract , and the fact she started to repay you is probably sufficient to win.

You have to ensure that the debt is being paid to the phone company to protect your credit.

I would contact the phone company and ask if they will settle for a payout figure lower than the outstanding bill. And cancel the service .

Well, first, if you haven't already, put a hold on the account! Then say that you can't keep paying her bill for her. You would need to fight her in court for her to reimburse you. I hope you had a written agreement that says she is to pay the bill in full. That would be best. Just don't go forging it. Oral contracts don't usually hold up in court, although if you had an agreement that was so one sided as a single phone cellphone contract, a court might agree with you. You'd have to go to small claims court, but it is best to try and fix it first.

Sorry pal, you're screwed. When you cosign - it's exactly the same as if you alone took out the contract. Call the company and see if you can cancel the contract and the phone service. They may just say yes.

It'll be quite tough I think but I'd suggest you check with your phone company and see if there's anything can be done. It's still your name after all and they have your ID, etc. The address doesn't matter much. And ultimately, you still need to confront your friend. She's to be responsible for what she's done.

Check out with the phone company. Legally, you can't get out of the contract.

You signed it; you owe it. There is no way to avoid this problem.
