Personally I don't see why not since she moved out, however, this might be something better left to the professionals

Of course he does, why on earth would you think otherwise. He could have moved someone in while she was there, he doesn't need her permission for anything.

Depending on how the agreement was written up, she might be in a bad position. She might not have the right to force a sale and continue to pay half of the bills. At best all she can do is force a sale and that is it.

It may depend on the laws of the state. One thing to consider - if he can't pay for the house himself and the new person helps pay the mortgage - wouldn't it be better to save the house rather than have it go into foreclosure?

I do believe that he can live with whomever he wants to...although he may be required by law to put the house up for sale and split the proceeds with the girl.
