My nephews mother gave him and his brother up 10 months ago to my brother, well then one boy wanted to go back to his moms but the other stayed willingly. Now she wants the other one back. But she isnt fit to be a mother. My nephews say she drinks all day, there are 9 people living in a 2 bedrrom trailer home. They say it stinks at the house. WHAT CAN WE DO???

Consult an attorney, and then do exactly as he/she directs you to. This case will be decided upon what is best for the child(ren); therefore, your brother and his lawyer will be working on demonstrating that your brother can provide the best care for your nephew(s) and that their mother cannot.

All you can do is to support your brother and your nephews - and that may very well turn out to be your greatest gift to all three of them.

Tell him to document document document...everything the kids tell him....get someone to drive by and take pictures....if he ever goes over there, take pictures. He can call Child Protective Services and tell them what is going on and ask them to investigate her and inspect her home....that he isn't happy with the living environment of the child that is there.....they will investigate...and will come unannounced....their investigation is submissable in court! Depending on how old the kids are, they judge may talk to them privately in quarters to get their take on what mom is up to and how their house is! Have him get notarized statements from witnesses who have seen her home drinking with the kids there and the condition of the house! I don't think I'd wait for her to file, it will look better on him if he pursues getting the custody of both kids!! Tell him to go see an attorney for a free consult and start saving money!
