Your name is not a requirement to file your taxes jointly. If you were married prior to 11:59 PM on December 31, 2006, you are eligible to file jointly, regardless of what your legal name is.

It makes no difference whether you change your name or not. Some people never change their names. You are required to file jointly for the period in which you were married.
