last year this couple filed together joint received tax refund and now this year found out they were overpaid. Spouse has set up arrangements with IRS to pay back but how can the debt now be split down the middle for the both of them since only seperated but living in two different states.

If it was a joint return, then either of you is individually liable legally for the entire amount - the IRS will get it from whoever they can get it from.

Good luck. The other person should really kick in half of the amount if they shared the refund last year, but there's no legal way to enforce that.

You are both legally liable for the debt, the IRS will take the money from both of your refunds, regardless of who has the bigger or smaller of a refund coming, They will keep both and apply it to the balance owed, If the first person who files their return has a refund that full pays the debt, the 2nd person could still get their refund,
