He left a dinner bar and had one beer while he was there. The police followed all the way through town, out of the city limits and up his driveway. Upon reaching the top of his driveway the police turned on his blue lights. When my friend got out of the car he said," why are you turning your lights on now ?" "And your out of your jurisdiction. " The police officer replied he saw him swurving and thought he was drunk. The officer then asked, "Is their anyone in the house?" My friend said, "No". At that time the officer maised him in the face, when he fell down he kicked him in the leg and broke his leg. When my friend said," Man, you broke my leg," he slammed his head into the concrete. Police told him to get up and walk a sobriety walk, he of course couldnot walk with a broken leg. We messured 30 ft. of blood stain where the officer made him walk on a broken leg. Because of the shock he was in he was in he was life flighted to local trauma hospital., they also forgot to do blood test.

I'm not saying it's impossible but the story sounds somewhat suspect....

You can refuse the breathalizer but then you license will be suspended and you will be arrested. Then they will get a warrent no matter what time it is and take you blood. So if you were drinking you will end up being screwed either way might as well just take teh breathalizer bec if you get a dui you license will not be suspended for a total year unless this is not your first. Learned about this in a class.

Where is your question?

Your friend must have been threatening or assaultive to the officers for him to have been maced. Police just don't pepper spray people willy-nilly because they are answering questions calmly. It does not make any sense that they would have him do a sobriety test after he had been pepper sprayed. How can you walk if you can't see?
Lots of details left out of this story.

So where's the question?... Your friend should sue the police department... or the officer in question and give a complaint to the PD.

He'll also get out of any charges, as now it's just cops word vs. his... and since the cop abused him, he should get off.

That's all if everything he's saying is true, and he didn't resist.

Do you really think that a kick would break his leg? And that he would be careflighted for a broken leg? I think your story has ALOT of extras added in. How bout telling the real story next time instead of a plea for sympathy

here we go again with another fairy tale.the general public has absolutely no idea whay jurisdiction entails.on duty status gives you jurisdiction in the entire city.if the officer nworks for the sheriff he has jurisdiction all over the entire county.odd duty status they both can enforce laws over the entire state.if either officer seea a law being broken they can follow that person out of any named jurisdiction

There was no question in there.

File a complaint with the police department and consider calling the papers or other local media.

find this hard to take serious, but just in case, as long as the officer got his P.C in the city limits he can follow as long as it takes to make the stop, as for the rest of it sounds a little funny to me, NO cop is going to put himself in that situation unless its nessesity. maybe your friends side of the sory is a little off the truth
