Hi i like to know if you are not working, not married but living together for 10 years and have a kids, he can not incluyed in his IRS report like dependant? and if you are not working, the person no report to the IRS? Thank you

Yes, The person working would file as Head of Household and claim everyone as dependents. You cannot file a joint return if you are not married. Keep in mind that if the other partner earns more than the personal exemption amount ($3300 for 2006) they are no longer a dependent. If the children belong to both of you, the head of household can claim EIC, Child Tax Credit, etc. If you get married, your filing status changes to MFJ even if only one of you is working.
