I am married. When I filled out my W4 for 2006, I selected the box that reads "Married, but wihtholding at the Single higher rate" to be on the safe side. All my paychecks report that I am being taxed Federal-1 and State-1 but come to find out, my taxable status is 'married.' My employer confirmed that this was THEIR error. I now owe $2000 to the government, including penalties for choosing the wrong tax status. Should I pay the $2k or is my employer liable? Should I ask my company to pay?

Yes, I have a copy of my W4 which is correct according to how I wanted to be taxed - "single" NOT "married"... my employer really did mess up.

Unfortunately, your employer is NOT liable for this, even though it was your error. The IRS regs state that it is the employees responsibility (not the employers) to make sure the taxes are being deducted correctly. Sorry

The employer might have messed up, but if they'd done it right the taxes would have already been deducted from your checks. Since they were yours to pay in the first place, and you haven't, it's your bill to pay, not your employer's.

they should pay as long as you have proof that they err'd. Like look at the w4 you filled out at the start of your job.

You can ask them to pay, but i seriously doubt they will. Do you have any proof that you selected that option? If so then you might have a chance....

Good Luck!
