The other parent is NOT claiming this child nor any Earned Income Credit associated with this child. Can I go for EIC if I meet all other requirements?

You cannot claim Earned Income Credit for your son if he did not meet the residency requirement of living with you for MORE THAN HALF OF 2006.

So, what I would do is add up all the days that he spent with you and see if it adds up to at least 183 days (half of 365) and then if it does you should be able to claim it if you meet all the other requirments like you said you did. Since he probably spent extra days with you for holidays or vacations ect., it will probably even out to at least half-I would think! :)

Do not do anything until you speak with a tax advisor! Most areas have free tax advisors located in rec centers or other public places like that. Only a tax advisor can tell you specifically if you can claim these items.

If you are legally able to claim the child, then yes, if the other options are valid, you can claim the EIC.
