it not only happens during the night but in the day time also. my legs feel achy and like they need to move, i just sit here and move my legs constantly all day and at night, i have to ball up my fist and put it on my lower back to get some relief. i have to sleep with my legs in these crazy positions, kind of like im trying to hurt them so the other pain will go away....what is this????

Sounds like it. I have been diagnosed with it and used to think all my symptoms were normal. I mentioned waking up like at least 5 times a night numb and not being able to move. It also happened when just sitting in one position, or even standing in one position. It is a weird condition, but can be helped a bunch with meds. I am on Mirapex. It is typically used for Parkinson's Disease, but apparently works for RLS too. Talk to the Dr. get the usual tests to diagnose it. I had to get an MRI on my neck and a sleep study, to rule out some other stuff. Could be restless leg syndrome. I have it but the meds that im on for my tourettes relieves the RLS also. I used to get it mostly at night when i was trying to sleep or sitting in the evening watching tv. It felt like a creepy sensation in my legs and i had to always move them. Its not a big deal, just talk to your doctor and he can prescribe you something to help.

Sounds like restless leg syndrome. My mom has it, and she had the same problems as you did. Think you need to see a doctor.
