Ignore Reverend he never has any idea what he's talking about, The French Foreign Legion are bad mofo's, comparable to Green Berets and yes they cannot surrender. I believe if they were to surrender, be taken prisoner, and found their way back to their headquarters they would most likely be tried and imprisoned, perhaps even put to death.

They follow this rule to the death:
It was in Mexico on 30 April 1863 that the Legion earned its legendary status. A small infantry patrol led by Capitaine Danjou, numbering 62 soldiers and 3 officers, was attacked and besieged by over a thousand Mexicans, organized in three battalions of infantry and cavalry, and was forced to make a defence in Hacienda Camarón. Despite the hopelessness of the situation, they fought nearly to the last man, with just three survivors and no ammunition and only the option to surrender, they fixed bayonets and attacked. The Mexican General was so impressed he assigned an honorguard to escort the body of Capitaine Danjou back to his battalion. - wikipedia

I don't know about the FFL, but the US Army code of conduct says that i will not surrender myself or my unit while i/we still have the means to fight.
